Rick Hoffmann, Mike Druzinski and Colin Cicotte successfully defended the firm’s client BorgWarner in a patent infringement suit filed by Modine Manufacturing Company. Modine alleged that BorgWarner infringed its U.S. Patent 8,033,323 related to an exhaust gas recirculation (EGR) cooler. In a decision handed down June 10, 2014, the United States Court of Appeals for the Federal Circuit issued a unanimous Judgment affirming the Eastern District of Wisconsin court’s decision to grant BorgWarner’s motion for summary judgment of non-infringement, concluding that BorgWarner’s accused EGR coolers do not infringe any claim of the Modine patent.
